Spectrum Management

The Communications Commission Tonga plays a critical role in managing the nation's radio frequency spectrum. Our mandate is to ensure this finite resource is used efficiently and effectively to support Tonga's social and economic development.

The management of spectrum resources is governed by established legal frameworks that define the rights and obligations of all users within the Kingdom.

Spectrum Licensing

Unless exempt, all persons must obtain a spectrum licence from the Commission before operating radio communications apparatus. This ensures orderly access and technical coordination.

  • Broadcasting Services
  • Maritime and Aeronautical Radio
  • Land Mobile Systems
  • Satellite Earth Stations
  • Fixed Point-to-Point Links

Licence-Exempt Spectrum Use

Certain low-power devices may be used without an individual licence, provided they comply with standard technical conditions to prevent interference.

  • Wi-Fi and short-range Bluetooth devices.
  • Unlicensed wireless microphones.
  • Low-power remote telemetry systems.
  • Operation must adhere to power limits and frequency bands specified by the Commission.

Note: Full details on licence categories are available in Schedule 1 of the Communications Radio Spectrum Rules 2019.

Important Notice: Licence-exempt users operate on a non-interference, non-protection basis. No protection from interference is provided for these services.

Fees and Charges

Spectrum fees are applied to recover costs and ensure the efficient management of the radio spectrum ecosystem in Tonga.

  • Bandwidth utilized.
  • Frequency band location and congestion levels.
  • Geographical area of operation.
  • Duration of the specific licence.

Interference Management

The Commission actively monitors the spectrum to detect and resolve unauthorized use that causes harmful interference to licensed services.

  • Radio monitoring and frequency surveys.
  • Investigation of interference complaints from authorized users.
  • Technical coordination with neighboring administrations.
  • Inspections of radio communications apparatus.

Compliance and Enforcement

The Commission ensures all spectrum users comply with the Communications Act 2015 and the Radio Spectrum Rules through various enforcement mechanisms.

  • Power to issue directions for technical modifications.
  • Suspension or revocation of spectrum licences.
  • Search and seizure of unauthorized apparatus.
  • Issuance of infringement notices and penalties.

Transitional and Legacy Licences

The Commission manages the transition of existing users to the current regulatory framework to maintain stability within the sector.

  • Reviewing legacy licence terms against new rules.
  • Re-issuance of licences under modern technical parameters.
  • Establishing timelines for compliance for existing operators.

Licence-Exempt Spectrum Use

Certain frequencies are designated for use without a specfic individual licence, provided the equipment meets technical standards. Examples include Wi-Fi, Bluetooth, and short-range devices.

  • Use must comply with the conditions in the Communications Radio Spectrum Rules 2019.
  • No protection is provided from interference caused by other users or services.
  • Devices must not cause harmful interference to licensed services.

Interference Management

The Commission maintains the integrity of the radio environment through active monitoring and technical coordination. We ensure that all licensed operators can provide services without disruption.

  • Investigation of reported signal degradation and harmful interference.
  • Regular field monitoring to ensure signal compliance.
  • Technical coordination between cross-border and local spectrum users.
  • Enforcing spectral masks and power limit standards.

Compliance and Enforcement

The Commission is empowered to enforce the Communications Act and relevant spectrum rules to protect the public interest and ensure fair use of resources.

  • Powers to inspect radio installations and equipment.
  • Authority to issue notices of non-compliance and administrative fines.
  • Power to seize equipment that operates illegally or causes danger.
  • Revocation of licences for persistent breach of technical conditions.
